<{ Laws and Punishments of Silveira }>

Guided by the culture of the Aorian people, citizens and foreign persons are obligated to follow the set laws made to maintain order and equality within its realms. Foreigners who have committed a crime within Silveira states will be confronted, questioned, or held on trial and treated according to the laws all the same as the citizens and nobles. Should there be drifters, they will be held accountable within the territories until answered for their crimes.
  • Note that crimes against any recognized healer within the Kingdom are doubled, as they are seen as life bringers.
  • The desecration of legal holy shrines, unless given passage to safely remove a shrine, will be charged as destruction of property and hereby protected by law.
  • People can also have multiple charges depending on the situation at hand.

<{ Nobles of House Silveira }>

These are the official set Laws of Silveira and the lands they rule over. The position of Duchy is the absolute ruling party, they are the highest in command and their word is the law. While the Duchy is able to give power, grant lands, titles, official positions, properties, and more, Family members of Silveira are able to appoint who they see fit to carry out the laws with the approval and acknowledgment of the Duchy.

Any officials or members of the Silveira Family above thirteen winters are able to suggest changes to the laws should the Duchy deem it fit, their word is final.

Should a family member, noble or vassal of House Silveira find themselves considered guilty of a crime declared by the Duchy, they will be held in a private trial with only the participants of the Duchy and Court. If the accused is found guilty or not guilty of their crimes, they will be treated with equal fairness like any other citizen.




<{ Laws of Nobility and Citizenry }>


Inside Silveira Lands
Persons who possess titles and official positions have the ultimate authority within their assigned jobs and titles. The laws in the founding documents they sign when swearing fealty to the Ruling Family and Country are absolute unless the Duchy strips it away. However, if a noble is to break a law, they will be put to trial. While a Noble is of higher status, a Citizen and Noble are treated fairly, as none is above one or the other, besides the Duchy. She or he is the embodiment of equality and order and is above the law.


Foreign Domestic Dispute
Foreign nobility or person of power is no exception, a person may be a Lord of a foreign land but they hold no power or status within Silveira lands or Aorian realms. Persons who attempt to enforce their laws in the states, arrest without warrant, or break any of the set laws will be questioned, tried, held accountable for their crimes or made an enemy of the state.


Outside of Silveira Lands
While outside of the Country borders, nobles of House Silveira may find themselves of some sort of recognition. However, like foreign nobles, they hold no power on outside soil they do not own or control, thus there is no legal obligation to treat them any differently than a lower class Citizen. If knowledge or suspicion of foul play is brought to the Duchy’s attention regarding her or his people, and appointed foreign diplomat or the Duchy themselves are obligated to travel to foreign lands and investigate the situation.



<{
Laws of Fealty }>

Fealty is the act of conformed loyalty to the state and its Duchy. Breaking an oath of fealty is considered high treason and would be met with severe consequences. To obtain a noble ship, a citizen of the Aorian Realm or foreign persons who have shown trustworthy actions must swear fealty to the Duchy land to the state. In addition to fealty, the Duchy is also entitled to decide reasonable conditions to how she or he sees fit whenever and however. A small ceremony may be held, to which it will be overseen by the Duchy and the Court.

<{ High Treason }>

When individuals attempt to bring ruin to the state and its inhabitants. It is committing a crime that seriously threatens the betrayal or endangerment of the Ruling Family or country. The accused will be given an interrogation and trial.

Coup
It is a planned illegal, unconstitutional seizure of power by the Duchy, Government, or a Political Faction vassal under Silveira. If a preponderance of evidence supports the existence of a coup conspiracy will be arrested and begin their trial. Evidence and charges stacked against them will result in severe punishments.

Serving acts of treason
Those who are found aiding acts of high treason against the Duchy will hereby be tried or banished from Silveira lands.

Ill intended Acts
Those who act out of ill intentions or treason towards the Duchy, Ruling Family, Council members, and endangering its inhabitants will be tried.

Plotting
The act of plotting against the Duchy, Ruling Family, or the Country will be tried.

<{ Misdemeanors }>

A misdemeanor is a lesser criminal act below felonies. Misdemeanors are generally punished less severely while maintaining administrative infraction and regulatory offenses. Many misdemeanors are punished with monetary fines or short prison sentences.


Trespass
-The act of stepping unto private or government-owned property without the consent and knowledge of the owner.
-Persons found trespassing onto private or government-owned or out of bounds property or area will be searched in case of dangerous items that may be in danger of the inhabitants and will be removed from them.

Small fine (200 Radiants)
For government or private properties of higher persons of power, the fine can be severe or result in imprisonment. (25,000 Radiants)

Petty theft
-To knowingly or unknowingly purloin property of low value from privately owned places or shops. Persons will be given a small fine and warning.

Short prison sentence

Small fine (100 Radiants)

Assault
-The attack, with or without provocation, on an innocent.
-Persons involved in the assault will be stripped of their weapons, armor, and anything related that is harmful before being escorted to jail depending on the severity of the assault.

Disturbing the peace
-The act of unruly behavior in a public place that causes disgust or discomfort of those nearby. This involves noise complaints, unnecessary duels, minor harassment and so on.

Forcing Religion
-Persons are not permitted to force religious views onto others in Silveira lands unless they are willing to learn or cooperate within reason. While religion is openly welcome to all good and non-carnage divines, citizens or foreign persons are to restrain from forcing religious views and aspects, as well as they, are legally obligated to decline.

<{ Felonies }>

A felony is defined as a crime that is considered to be more serious than a misdemeanor. Felony is a category of crimes that are often classified as the most serious type of offenses that do not involve capital crimes or high treason. Felonies can be either violent or nonviolent.

Riot
The violent disturbance of the peace of a once calm location, typically created by a group or crowd.

-To stir up or encourage a violent disturbance of peace for either personal or nonpersonal goals

Attempted Murder/Grievous assault
-The failed attempt at the harming of a person with an intent to dispose of the person. These acts may fall under second-degree murder.

-The act of forging literature, arts, documents, or other such media previously owned by another under your own name.

Destruction of property
-To burn or otherwise destroy property that is not owned by yourself.

Theft
-The act of purloining an item of medium to high value from a privately owned property or shop.

Return all stolen goods

Robbery
-The act of known burglary and henceforth fleeing the scene. An individual who does not flee the scene is still considered a criminal, and will still be punished with the crime accordingly.
-{For Merchants} The act of swindling or overpricing goods in the efforts of gaining from another’s wealth.

Slander
-Slander is the act of a false spoken statement about an individual that damaged their reputation or a situation, making of such a statement that stray from reality

Vyres
-While Vyres are welcome within Linistel, they are obligated to follow the following set laws. They are forbidden to force turn an individual or feed off without consent, this regards the consent of citizens and foreigners. If a Vyre is to break these laws, they will meet the required punishments.

Cults
Any knowledge of ill-willed cults within Linistel or Silveira lands rallying people, attempting to recruit or pressure individuals to join their ranks, whether it is physically or verbally will meet the following punishments.

<{ Capital Crimes }>

A Capital offense is a crime that is considered to be the highest law set crimes beneath high treasons, such as murder or betrayal of one's country or it's citizens, that is treated so seriously that death may be considered appropriate punishment.
Murder
To cause harm intentionally wherein the result is the death of the victim. To take another’s life is viewed as a heinous act, and is treated as one of the worst acts one can commit. If a person has committed this crime, they are sentenced to imprisonment until the day of their trial.

First Degree Murder
First-degree murder is an act when an individual has committed intentional murder with the process of willingness and thoughtfully planned initiative. Punishments consist often consist of public lashings, hard labor or death depending on the severity and motivation of the murder.
Second Degree Murder
Second-degree murder is applied when an individual has committed unintentional murder that was not planned or considered beforehand. Punishments consist often consist of public lashings or hard labor, however, death can be considered depending on the severity and motivation of the murder.
Manslaughter
Manslaughter is considered to be a common legal term for homicide against the law that is less culpable than murder. The distinction between murder and manslaughter is it is an unlawful killing that doesn’t involve malice aforethought intent to seriously harm or kill, or extreme, reckless disregard for life. The absence of malice means that manslaughter involves less moral blame than either first or second-degree murder and the Court is legally allowed to investigate further for the well-being of the citizens and the accused.
Depending on the severity, the following will be applied to the Court decision.
If Manslaughter becomes of Self-Defense
Should the investigation show the accused defending themselves from an attacker resulting in severe harm or death of the attacker, their punishment is legally obligated to reduce and they will be examined for mental treatment.
If Manslaughter becomes involuntary
Should the investigation show the accused to commit manslaughter without malice aforethought, they are to be sentenced to prison while under examination or further investigation.
If Manslaughter becomes voluntary
Should the investigation show the accused to commit manslaughter with malice aforethought, they are to be sentenced to prison while under examination or further investigation. This may lead to potential first or second-degree murder, depending on the results found.

Slavery and Abduction
-Slavery is the act to keep another sentient being under your contract or ownership in the hopes of selling said person’s freedom.
-Abduction is the act of when someone uses deceit or force in order to take a person away from their home or relatives against their will. This law also falls under kidnappings, where the accused has forcibly transported a person against their will and holding them in false imprisonment, a confinement without legal authority.
-Slavery and abduction found in anyway, shape or form will be dealt with immediately whether by cooperation or by force for persons freedom and the accused arrested, sent to jail until further notice.

Unlawful Detainment
-Those who are to coerce or otherwise force another sentient being into restraint/arrest, typically without the authority to do so will be questioned or fined. Persons must discuss with the Duchy or General for a legal position to do so. If they are legally able to restrain or arrest a person, they are allowed to escort them to the prisons.

Bribery
-The illegal persuasion of a person or organization through gift, promise, or monetary reward.

Counterfeiting
-The illegal forging of legal documents and currency in order to instantiate fraudulent purchases or any governmental action for personal advancement.

Impersonating the Ruling Family / Public Officials
-To pretend to act as though one were a known member of the governing party or any authoritative power granted thereof.
