In the city of Storm's Landing, there is a major facet of government: The Council of Five.
The Council of Five receives and relays the whims of the people.
Law and Order, by our own hand, or none.

s per its name, the Council of Five is a group of five officials elected by the citizens of Storm's Landing. The duties of the Council are meant to serve the needs of the people. Their responsibilities include bringing the concerns of the citizens heard on a personal basis to the rest of the council and finding solutions for said problems; changing, modifying, adding, or removing laws based on a majority vote; adding to their responsibilities, reasonably, based on a majority vote; assisting in managing aspects of the Guard, such as salary and the choosing of the Captain; overseeing trials and punishments for crimes within the Landing; voting on proposed ideas, developments, and advancements for the Landing; general presence in events and other festivities within the Landing; and working with the Treasurer to oversee the economy & finances. They may become involved in Guard-related matters that cannot be solved internally.

Every three (OOC) months, members eligible for re-election will be voted on by the citizens, alongside those newly campaigning for a space on the council. If a member is unexpectedly removed or takes leave, an emergency vote will be initiated, or the runner-up from the previous election may take the open space.

Each Council Member is compensated with a stipend of 4,000/r at the beginning of their term, and 4,000/r at the end of their term.

OOC Regulations

The King's Law must always be followed.
A term for Council members is three months. Re-election is possible indefinitely.
If a Council member, is absent for three (OOC) months, they are ineligible for re-election for two election cycles. (6 OOC months).
If an alt run by a member of the Council is implicated in an incident, they must step back from any deliberation on the matter.
The rent system may not be removed.

[Investigation and Removal from Office]

Duly-elected officials are public servants which are legally sworn into an office which must be won by election. These officials normally have terms, wherein they must seek re-election at a terms’ end in order to maintain office. If such an official is to be removed from office before their legal term is complete, the following method must be applied and completed in its entirety. This method is referred to, for these purposes, “Formal Inquiry”.

Formal Inquiry proceedings have four main steps:

Announcement of Intent for Formal Inquiry
  1. Formal Inquiry is a kind of investigative process instigated by a sitting City Councilmember during open session. The purpose of this investigation is to collect evidence which may be used to remove an elected official from office before their term is complete.
  2. This process shall only be announced if the City Councilmember so instigating has sufficient reason and cause to do so.
  3. City Councilmembers may announce Intent for Formal Inquiry as a simple motion which requires no permissions or votes, but shall state their sufficient reason and cause. The City Councilmember who announces Intent must also make a recommendation for an investigator to lead the Formal Inquiry.
Authorization of Formal Inquiry & Appointment of a Special Investigator
  1. When Intent for Formal Inquiry has been announced by a City Councilmember, and the sufficient reason and cause heard, and the recommendation for investigator heard, the City Council must then vote to authorize the Formal Inquiry with simple majority to pass.
  2. Formal Inquiry can not be authorized without the joint appointment of an investigator.
  3. The investigator is given the title of “Special Investigator for City Council” for the duration of the Formal Inquiry.
  4. This individual may be anyone deemed so qualified by the City Council, but if it is selected from a member of City Council, they must stand down from their seat as City Councilmember for the duration of the Formal Inquiry. The Special Investigator shall not be the individual which is the subject of the Formal Inquiry.
  5. In authorizing the Formal Inquiry and in appointing the investigator, the City Council shall define the scope of the Formal Inquiry and the powers of the Special Investigator in plain terms, and these terms shall be adhered to for the entire duration of the Formal Inquiry.
Special Investigator’s Report & Recommendation
  1. With the Formal Inquiry authorized, investigator appointed, and their scope defined, the investigation begins. The Special Investigator is empowered with any means stipulated by their authorization.
  2. The Special Investigator conducts the Formal Inquiry for as long as defined by the City Council, or until the investigation is complete, or until the City Council orders the Formal Inquiry to be completed.
  3. At such time where the investigation is complete, the Special Investigator shall collect their entire comprehensive findings into the Special Investigator’s Report. This report shall contain a recommendation of the action which the City Council should take.
  4. Recommendation is the opinion of the Special Investigator, but it shall be informed by the findings of the Formal Inquiry.
Review of Materials & Formal Trial
  1. All City Councilmembers shall review the Special Investigator’s Report.
  2. City Councilmembers then vote to either end the proceedings or continue to a formal trial.
  3. A supermajority (greater or equal to two-thirds the City Council) must vote to end the proceedings in order to avoid a formal trial. Anything less than a supermajority vote in favor of ending the proceedings means a formal trial will take place.
  4. The City Council shall then appoint a Justiciar, which shall not be the individual which is the subject of the Formal Inquiry, and which shall not be the individual which announced the Formal Inquiry, and which shall not be the individual which was appointed as Special Investigator. The Justiciar does not need to be a member of the City Council.
  5. The Justiciar runs the trial, which is decided by the City Council to be either public or private by a simple majority vote.
    1. The Defendant in the trial is the individual which is the subject of the Formal Inquiry, and is entitled to legal counsel and to call witnesses.
    2. The Prosecution is the Special Investigator, and is entitled to whatever additional resources stipulated by their scope, and to call witnesses.
    3. The Justiciar is responsible for accepting or rejecting witnesses called, and for moderating the trial.
    4. The City Council stands as Jurors for the trial. If the individual on trial is a City Councilmember, they shall not stand as Juror.
    5. When all witnesses allowed by the Justiciar have been heard, the Jurors convene and decide to either remove the elected official which is the subject of the Formal Inquiry from office, or to sustain this same elected official for the duration of their term.
  6. The Formal Trial is complete when the Justiciar announces the decision reached by the Jurors. This ends the Formal Inquiry. At this time, the Special Investigator loses whatever powers defined by the City Council.
  7. The will of the court shall be abided: if the Defendant was found guilty, they are removed from office; if the Defendant was found innocent, they are sustained.
